Terms of Use for Zoria

These Terms of Use ("Terms") are a legal agreement between you and the developer of Zoria ("we", "us", "our") governing your use of the Zoria mobile application ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, don't use the App.
1. What Zoria is
Zoria is an ambient-sound app: a library of bundled, offline-playable sounds (rain, ocean, white noise, and similar) with a sleep timer, sound layering, Lock Screen controls, and related features, intended to help with sleep, relaxation, and focus.
Zoria is not a medical device and does not provide medical advice. It is not intended to diagnose, treat, cure, or prevent insomnia, sleep apnea, or any other medical condition. If you have a sleep disorder or any health concern, consult a qualified healthcare professional — don't rely on the App as a substitute for medical care.
2. Who can use Zoria
You must be able to form a binding contract to use the App, and you must comply with any minimum age requirement of your local app marketplace (the App Store's age rating for Zoria reflects this). If you are using the App on behalf of a minor in your care, you are responsible for their compliance with these Terms.
Zoria has no user accounts, sign-in, or profile system — there is nothing to register for.
3. Subscriptions, free trials, and billing
Zoria offers auto-renewing subscription plans (currently monthly and yearly) that unlock the full app. Some plans may include a free trial (currently 3 days by default; the exact length is always shown in the app before you subscribe, and may change over time).
By starting a subscription or trial, you agree that:
- Billing. Payment is charged to your Apple ID (or Google Play) account at confirmation of purchase. We never see or store your payment card details — all billing is handled entirely by Apple's App Store (or Google Play, where applicable).
- Auto-renewal. Your subscription automatically renews for the same period unless you turn off auto-renewal at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price shown in the app at the time of purchase (subject to any price-change notice required by Apple/Google).
- Free trial eligibility. Introductory free trials are typically offered once per subscription group per account, as determined by Apple/Google — not by us. If you've already used a trial (even if you later cancelled), you may not be offered another one on a later resubscribe; the App will show you accurate pricing before you confirm.
- Forfeiture of unused trial time. Any unused portion of a free trial period is forfeited at the moment you purchase a subscription, where applicable.
- Cancellation. You can cancel or manage your subscription anytime from your device's Account Settings (Settings > [your name] > Subscriptions on iOS), or from the "Manage Subscription" option inside the App, which links directly there. Cancelling stops future renewals but does not refund the current billing period.
- Refunds. Refund requests are handled by Apple/Google under their own refund policies, not by us directly — we have no ability to issue refunds ourselves since we never process payments.
- Restoring purchases. If you reinstall the App or switch devices, use the "Restore Purchases" option to reconnect an active subscription tied to your Apple ID/Google account — no separate account or password is needed.
4. License to use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Zoria on Apple-branded devices (or Android devices, where available) that you own or control, for your own personal, non-commercial use, and as permitted by the usage rules set out in the applicable app marketplace's terms of service.
You may not:
- Copy, modify, reverse-engineer, decompile, or create derivative works of the App or its bundled sound content, except to the extent applicable law prohibits this restriction;
- Redistribute, sell, rent, lease, sublicense, or otherwise make the App or its content available to any third party outside of using the App as intended;
- Use the App for any unlawful purpose, or in a way that could disable, overburden, or impair it;
- Remove or alter any proprietary notices on the App.
5. Intellectual property
The App, including its name, logo, design, software is owned by us (or our licensors) and is protected by copyright, trademark, and other intellectual property laws. Using the App under the license in §4 does not transfer ownership of any of this to you.
6. Your device permissions
Zoria may request permission to send you local notifications (for example, a reminder before a free trial ends, or a nudge to subscribe). These are generated entirely on your device. You can withdraw notification permission anytime in your device's system Settings without affecting the rest of the App's functionality.
7. "As is" — no warranty
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. We don't guarantee the App will be uninterrupted, error-free, or available at all times.
8. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of (or inability to use) the App, even if we've been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot legally be limited (e.g., liability for our gross negligence, willful misconduct, or death or personal injury caused by our negligence, where applicable law says so).
9. Termination
You may stop using the App at any time by deleting it from your device and cancelling any active subscription. We may suspend or terminate your access to the App if you violate these Terms, though because the App has no accounts, this in practice means we may discontinue the App or specific versions of it. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.
10. Changes to the App or these Terms
We may update, modify, or discontinue features of the App, and may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the updated Terms.
11. Apple App Store — additional terms
If you downloaded Zoria from Apple's App Store, the following additional terms apply and take precedence over any conflicting term above, per Apple's requirements for apps that supply their own end-user license agreement:
- These Terms are between you and us only, not Apple, and Apple is not responsible for the App or its content.
- The App may only be used on an Apple-branded product that you own or control, and as permitted by the App Store's Usage Rules.
- We, not Apple, are solely responsible for providing any maintenance and support for the App, to the extent required by these Terms. Apple has no obligation whatsoever to furnish any maintenance or support for the App.
- We, not Apple, are solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
- In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.
- You must comply with any applicable third-party agreements when using the App (for example, your wireless data service agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
12. Export compliance
You agree to comply with all applicable export and re-export control laws and regulations, including those of the United States, in your use of the App.
